All orders placed with Ewin Racing AU, agree and accept the Terms & Conditions stated below.

Warranty and Disclaimer

Ewin Racing AU offers a 5-year parts warranty that begins from the date of purchase.

Warranty covers issues identified as faulty or defective. Damage and issues caused by improper installation, usage or accidents are NOT covered by the 1-year warranty.

The decision of granting a warranty claim is made at the discretion of the Ewin Racing Sales Department.

Product Dispatch & Shipping Delivery

Delivery times and dates provided by Ewin Racing AU are estimates only and not a term of contract. Please ensure that you have checked the delivery specifics online or contacted us.

Customers located in regional areas may experience slight delays in receiving product due to difficulties in logistics.

Ewin Racing AU is not liable for for any loss or damage in respect of any delay in delivery.

Additional Fees

Occasionally, shipping to remote regions of Australia will require an additional shipping fee, which can be completed via Phone or Email. This is due to the large, bulky nature of the items that are being transported, along with the vast distances which lead to potentially significantly higher costs of delivering an item to remote regions.

Returns

If for whatever reason you do change your mind and would like to return your order after delivery, we’re happy to refund or exchange your purchase as long as it is unopened and in its original packaging. This option is available for 14 days after delivery 20% Restock/Cancellation fee applies plus the shipping fee of the product and the booking returned to us.

We will accept stocked items back even if you have opened the goods to inspect them. You are entitled to a refund as long as you return your goods within 7 working days from the day of delivery. The goods must in an ‘as new’ condition and returned in the original, undamaged packaging. The product must not have been used or installed. Whilst the goods are in your possession you must take reasonable care of them and not use them.

As per the ACCC Refunds & Returns Policy

We are not required to provide a refund or replacement if you change your mind. But you can choose a refund or exchange if an item has a major problem. This is when the item:

• has a problem that would have stopped someone from buying the item if they had known about it

• is unsafe

• is significantly different from the sample or description

• doesn’t do what we said it would, or what you asked for and can’t be easily fixed.

Alternatively, you can choose to keep the item and we will compensate you for any drop in value. If the problem is not major, we will repair the item within a reasonable time. If it is not repaired in a reasonable time you can choose a refund or replacement. Please keep your proof of purchase—e.g. your receipt.

Cancellations

1.1 Ewin Racing Au reserves the right to cancel, at any time before delivery and for whatever reason, an Order that it has previously accepted. Ewin Racing Au may do this for example, but without limitation, where:
(a) Ewin Racing Au's suppliers are unable to supply Goods that they have previously promised to supply;
(b) an event beyond Ewin Racing Au control, such as storm, fire, flood, earthquake, terrorism, power failure, war, strike, pandemic, governmental action or failure of computer systems, means that Ewin Racing Au is unable to supply the Goods within a reasonable time;
(c) Goods ordered were subject to an error on the Website, for example, in relation to a description, price or image, which was not discovered prior to the Order being delivered;

1.2 You may cancel your Order where Ewin Racing Au (a) has breached a material term of this Agreement; (b) is not able to deliver your Order within a reasonable time of the estimated delivery time listed on the Website for the applicable Selected Delivery Option, other than a result of any delay: (i) for which you are wholly or partly responsible such as a failure to provide the correct delivery address or to pay for the Goods; or (ii) which was outside Ewin Racing Au control including the situations set out in Sections 1.1(a) and (b) above.

1.3 Where Ewin Racing Au cancels your Order after acceptance it will send you an e-mail notifying you of cancellation.

1.4 In the event of Ewin Racing Au or you cancelling your Order after payment has been processed, Ewin Racing Au will refund any money paid in respect of that Order. Section 1.6 of these Terms and Conditions sets out further information about refunds.

1.5 Except to the extent otherwise required by law (including, without limitation, the Australian Consumer Law) or as expressly set out in these terms and conditions, Ewin Racing Au will not be liable to you, or any other person, for any loss, damage, cost or expense suffered as a direct or indirect result of cancellation of your Order, whether in contract, negligence or any other tort, equity, restitution, strict liability, under statute or otherwise at all.

1.6 Where Ewin Racing AU is obliged to refund your payment pursuant to these Terms and Conditions, JB Hi-Fi aims to initiate your refund to your original payment method(s) within 7 business days (Monday – Friday 9 am to 5 pm Melbourne time). The additional time that it takes for you to actually receive your refund will depend upon how quickly your financial institution or other payment provider processes the refund.
